Under and by virtue of a Power of Sale contained in that certain Deed of Trust executed by Tony Cameron and Martha G. Cameron, Husband And Wife to Fuss & Fairley PC, Trustee(s), which was dated January 26, 2004 and recorded on January 30, 2004 in Book 4178 at Page 902, New Hanover County Registry, North Carolina.

Under and by virtue of the power of sale contained in a certain Deed of Trust made by Johnny S. Driggers and Alice F. Driggers to F. If the trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit.  Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the confirmation of the sale and reinstatement of the loan without the knowledge of the trustee.  If the validity of the sale is challenged by any party, the trustee, in their sole discretion, if they believe the challenge to have merit, may request the court to declare the sale to be void and return the deposit.  The purchaser will have no further remedy.

If the recipient wishes to contest the sale of his property pursuant to such lien, the recipient should notify the lienor that a hearing is desired. To contest the sale you must return the attached Contest of Sale form within the ten (10) day period provided. Failure to notify the lienor within ten (10) days of the receipt of this Notice shall be deemed a waiver of right to a hearing prior to sale of the property against which this lien is being asserted, and the lienor may proceed to enforce the lien.

NOTICE OF DISPOSITION OF SURPLUS PROCEEDS: Please take notice that any proceeds from the sale of the vessel remaining after payment of the amount claimed to be due and owing to the lienor plus payment of reasonable expenses incurred in connection with the lien enforcement sale will be returned to the above listed owner or if such person cannot be found, shall be paid to the clerk of superior court of the county of New Hanover, NC in accordance with NC G.S. 44QA-5.
