NOTICE OF SALE

Under and by virtue of the power and authority contained in the above-referenced deed of trust and because of default in the payment of the secured indebtedness and failure to perform the stipulation and agreements therein contained and, pursuant to demand of the owner and holder of the secured debt, the undersigned substitute trustee will expose for sale at public auction to the highest bidder for cash at the usual place of sale at the county courthouse of said county at 10:30AM on October 28, 2015 the following described real estate and any other improvements which may be situated thereon, in New Hanover County, North Carolina, and being more particularly described as follows:

The land referred to herein below situated in the County of New Hanover, State of North Carolina, and is described as follows:

Beginning at a point in the Eastern right of way line of Myrtle Grove Loop Road (SR #1492, 60 foot right of way), said point being located 382.41 feet as measured Southwardly along the Eastern right of way line of said Myrtle Grove Loop Road from its point of intersection with the Southern right of way line of Southerland Road (SR #1521, 60 foot right of way, also known as Rogers-Williams Avenue); and running thence, from said Beginning point, with the Southern line of the Richard Karl Hoppe tract as described in a Deed recorded in Book 1303, Page 1032 of the New Hanover County Registry South 71 degrees 10 minutes 30 seconds East 180.03 feet to an old pipe that marks the Southeastern most corner of the above mentioned Richard Karl Hoppe Tract; running thence, with the Eastern line of said Hoppe Tract North 16 degrees 26 minutes 15 seconds East 111.14 feet to an old pipe in a large ditch; running thence, with said ditch South 81 degrees 13 minutes 30 seconds East, 116.515 feet to a paint in said ditch, said point being located South 22 degrees 59 minutes 30 seconds West 3.8 feet from an old pipe on the Northern edge of said ditch; running thence, with the Western line of the Terry E. Godwin tract as recorded in Book 1163, Page 385 of the New Hanover County Registry South 22 degrees 59 minutes 30 seconds West 275.73 feet to an old pipe; running thence, with the Northern line of the George P. Piner tract as recorded in Book 511, Page 188 of the New Hanover County Registry North 67 degrees 23 minutes 45 seconds West 270.72 feet to a new pipe in the Eastern right of way line of the Myrtle Grove Loop Road; running thence, with the Eastern right of way line of the Myrtle Grove Loop Road North 18 degrees 51 minutes East 125.78 feet to the point of Beginning, containing 1.15 acres more or less.

The above described tract being the same lands asdescribed in Book 973. Page 644, and book 1284, Page 1413 with the exception of the lends described in Book 1303, Page 1032 of the New Hanover County Registry.

Excepting therefrom the following:

Beginning at an old iron pipe which is the Southeast corner of that tract conveyed to Peter Gillman-Bryan and wife, Carolina Gillman-Bryan by deed recorded in Book 1531 at Page 1003 of the New Hanover County Registry, said Beginning point also being South 71 degrees 10 minutes 30 seconds East 180.03 feet from an old iron pipe in the Eastern right of way line of Myrtle Grove Road (SR 1492)(60 foot row) said old iron pipe in the center line of Myrtle Grove Road which point is approximately 410 feet South of the intersection of the centerline of piner road with the centerline of Myrtle Grove Road and running thence from the Beginning South 71 degrees 10 minutes 30 seconds East 100.51 feet to an iron pipe thence North 22 degrees 59 minutes 30 seconds East 131.73 feet to an iron pipe thence North 81 degrees 73 minutes 30 seconds West 116.51 feet to an iron pipe (the Northeast corner of Peter and Carolina Gillman-Bryan); thence with and along the existing Peter & Caroline Gillman-Bryan line South 16 degrees 26 minutes 15 seconds West 111.14 feet to the Beginning, the same being approximately 0.3 acres.

And Being more commonly known as:  5629 Myrtle Grove Rd, Wilmington, NC 28409

The record owner(s) of the property, as reflected on the records of the Register of Deeds, is/are Betty Jo Cook.

The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance “AS IS, WHERE IS.” Neither the Trustee nor the holder of the note secured by the deed of trust, being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representative of either Trustee or the holder of the note make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale.  Any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed.  This sale is made subject to all prior liens and encumbrances, and unpaid taxes and assessments including but not limited to any transfer tax associated with the foreclosure.  A deposit of five percent (5%) of the amount of the bid or seven hundred fifty dollars ($750.00), whichever is greater, is required and must be tendered in the form of certified funds at the time of the sale.  This sale will be held open ten days for upset bids as required by law. Following the expiration of the statutory upset period, all remaining amounts are IMMEDIATELY DUE AND OWING. Failure to remit funds in a timely manner will result in a Declaration of Default and any deposit will be frozen pending the outcome of any re-sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid.  The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, the Substitute Trustee or the attorney of any of the foregoing.

SPECIAL NOTICE FOR LEASEHOLD TENANTS:  If you are a tenant residing in the property, be advised that an Order for Possession of the property may be issued in favor of the purchaser.  Also, if your lease began or was renewed on or after October 1, 2007, be advised that you may terminate the rental agreement upon written notice to the landlord, to be effective on a date stated in the notice that is at least 10 days, but no more than 90 days, after the sale date contained in the notice of sale, provided that the mortgagor has not cured the default at the time notice of termination is provided. You may be liable for rent due under the agreement prorated to the effective date of the termination.

Proposed Flood Hazard Determinations for New Hanover County, North Carolina and Incorporated Areas

The Department of Homeland Security’s Federal Emergency Management Agency has issued a preliminary Flood Insurance Rate Map (FIRM), and where applicable, Flood Insurance Study (FIS) report, reflecting proposed flood hazard determinations within New Hanover County, North Carolina and Incorporated Areas.  These flood hazard determinations may include the addition or modification of Base Flood Elevations, base flood depths, Special Flood Hazard Area boundaries or zone designations, or the regulatory floodway.  Technical information or comments are solicited on the proposed flood hazard determinations shown on the preliminary FIRM and/or FIS report for New Hanover County, North Carolina and Incorporated Areas.  These flood hazard determinations are the basis for the floodplain management measures that your community is required to either adopt or show evidence of being already in effect in order to qualify or remain qualified for participation in the National Flood Insurance Program.  However, before these determinations are effective for floodplain management purposes, you will be provided an opportunity to appeal the proposed information.  For information on the statutory 90-day period provided for appeals, as well as a complete listing of the communities affected and the locations where copies of the FIRM are available for review, please visit FEMA’s website at www.fema.gov/plan/prevent/fhm/bfe, or call the FEMA Map Information eXchange (FMIX) toll free at 1-877-FEMA MAP (1-877-336-2627).
