Under and by virtue of the power and authority contained in the above-referenced deed of trust and because of default in the payment of the secured indebtedness and failure to perform the stipulation and agreements therein contained and, pursuant to demand of the owner and holder of the secured debt, the undersigned substitute trustee will expose for sale at public auction to the highest bidder for cash at the usual place of sale at the county courthouse of said county at 11:00 AM on February 28, 2013 the following described real estate and any other improvements which may be situated thereon, in New Hanover County, North Carolina, and being more particularly described as follows:

TRACT ONE

Being all of Lot 36, Block 16, Pembroke Jones Park at Landfall Subdivision, according to the plat and survey thereof as recorded in Map Book 30, at Page 147, New Hanover County Registry, to which plat reference is hereby made for a more particular description of same.

Together with the rights, responsibilities and easements contained in the Declaration of Covenants, Easements and Restrictions for Pembroke Jones Park at Landfall Subdivision recorded in Book 1399, at Page 1310, New Hanover County Registry, and as amended in Book 1529, Page 878 and in Book 1537 at Page 241, New Hanover County Registry, and any further amendments thereto.

This property is conveyed and accepted subject to easements of record affecting said property; the provisions of applicable zoning and land use ordinance, statutes and regulations; and 1995 and subsequent years’ ad valorem taxes.

An Additional 1,657 Square foot tract of land to Lot 36 of- Reference Map Book 30, Page 147 and Deed Book 1966, Page 463 Harnett Township, New Hanover County, North Carolina.

Being all that certain tract of land lying and being located in Harnett Township, New Hanover County, North Carolina and being bound on the North by additional property for (Lot 38R) of Map Book 30, Page 147 as recorded in the New Hanover County Registry in Deed Book 1671, Page 517 bound on the east by (now or formerly) property of Robert and Linda Brady in Deed Book 1966, Page 463. Bound on the South and West by property of Landfall Associates and being more particularly described as follows:

Commencing from an existing iron pipe, the Point of Beginning, located in the northwestern corner of Robert and Linda Brady (Lot 36) and the southwestern corner of (Lot 38R) and thence running with the common abandoned property line of Lot 36 S 17 deg. 50’59” E 100.23 feet to an existing iron pipe. Thence running with a new property line S 76 deg. 53’56” W 18.86’ to a new iron pipe; thence running N. 19 deg.09’21” W 9.57’ to a new iron pipe. Thence running N 13 deg. 52’09” W 61.48’ to a new iron pipe. Thence running N 35 deg. 15’18” W 19.81’ to a new iron pipe. Thence running N. 35 deg. 15’18” W 3.10’ to a new iron pipe. Thence running N 17 deg. 37’25” W 8.97’ to a new iron pipe. Thence running N 54 deg.19’05” E 22.65’ to a new iron pipe and said pipe being the point of beginning containing 1,657 square feet and being shown on an Exhibit Map prepared by Hobbs Surveying Company, Inc. dated December 14, 1998 to which reference is hereby made for a more full and accurate description.

The record owner(s) of the property, as reflected on the records of the Register of Deeds, is/are Gregory P. Gianoplus.

SPECIAL NOTICE FOR LEASEHOLD TENANTS: If you are a tenant residing in the property, be advised that an Order for Possession of the property may be issued in favor of the purchaser.  Also, if your lease began or was renewed on or after October 1, 2007, be advised that you may terminate the rental agreement upon 10 days written notice to the landlord.  You may be liable for rent due under the agreement prorated to the effective date of the termination.
