Pursuant to an order entered April 30, 2013, in the Superior Court for New Hanover County, and the power of sale contained in the captioned deed of trust (“Deed of Trust”), the undersigned Substitute Trustee will offer for sale at auction, to the highest bidder for cash,

the real estate and the improvements thereon secured by the Deed of Trust, less and except any of such property released from the lien of the deed of trust prior to the date of this sale, lying and being in New Hanover County, North Carolina, and being more particularly described as follows:

In the Trustee’s sole discretion, the sale may be delayed for up to one (1) hour as provided in Section 45-21.23 of the North Carolina General Statutes.

TAKE NOTICE that a small claim action has been commenced against you in the above-entitled action seeking relief against you.  The nature of the relief being sought is Judgment against you in the sum of $2,779.52 together with interest from the date of judgment at the rate of 8% per annum until paid.
You are notified to appear at the trial before the magistrate on the 20th day of June, 2013, at 10:00, a.m. at Small Claims Courtroom 514, New Hanover County Judicial Building, Wilmington, North Carolina. You will have the opportunity at the trial to defend yourself against the claim stated above.  You are required to make defense to such pleading not later than June 17, 2013 and upon your failure to do so the party seeking service against you will apply to the Court for the relief sought.  Whether or not you file an answer, the plaintiff must prove the claim before the magistrate. 
If you fail to appear and defend against the proof offered, the magistrate may enter a judgment against you.
